Botswana: Housewife Seeks P50,000 Damages

The judgement in a case which a 35-year-old Ramotswa woman, Obakeng Madubela, is suing a certain Sadi Nokane, also from Ramotswa, for defamation and violation of her right to privacy by divulging her HIV status in public, will be delivered today by the Lobatse High Court.

The housewife, who also claims that her marriage has broken down irretrievably, is demanding P50,000 compensation from her rival. Madubela, who is represented by Botswana Network on Ethics, Law and HIV/AIDS (BONELA), is seeking compensation from Nokane for defamation of character through the utterance of malicious statements aimed at lowering her estimation in the eyes of right thinking persons.

Madubela alleges that Nokane has wrecked her marriage by having an affair with her husband. She is therefore asking the court to grant her P50, 000 as compensation for her damaged self-esteem, reputation and dignity.

It is alleged that the first time she was publicly abused by the defendant was on December 25, 2006 at a bar called Dinompolae, with the second incident, taking place in June 2007.

The words were uttered in Setswana and she said, 'ke go boditse gore o tlhala leng ngwana wa batho, molwetse ke wena wa mogare.'

Six months later, the defendant is reported to have again abused the complainant in front of her co-workers at Score Supermarket, adding that she failed in her marriage because of her HIV positive status, reiterating the same question she previously asked her, as to when she plans to divorce her husband, before she infects him with the virus.
